As if dealing with cultural differences was not enough, you have to worry about legal stuff such as getting visa for your Russian fiance and later applying for her green card. Getting green card through marriage shouldn’t be the hassle, but quite frequently it turns out to be.
If you don’t know what to do, the process can be quite painful and annoying because the government officials don’t allow you to make any mistakes and from our experience they are not very helpful if for some reason you get stuck and have some questions. If you accidentally screw something up they will make your life much more complicated.
We had quite an experience with green card application. USCIS decided to schedule my green card interview on my due date (I was pregnant with our first child). We got the appointment notice from them when I was 4 months pregnant and we tried really hard trying to reschedule it. I had some complications during pregnancy and I was worried that I would go into labor during my interview and 2 hours away from our home.
USCIS didn’t cooperate – they basically said that it is not their problem and if I can’t come (due to a valid reason), they will reschedule my interview. Well, guess what? I went into labor the night before my scheduled interview and my husband had to call USCIS from delivery room to tell them that we are not going to make it.
They said, OK we’ll send you a letter with a new appointment date soon.
Four months later we still didn’t hear from them. We called, wrote letters and emailed- NOTHING. I think once we got a hold of someone who told us that it was my fault for missing the interview (never mind the reason), so it will take awhile before they can see me again.
We were hoping to go to Russia that year and the situation was making us really upset. My husband called the senator, explained the situation and asked him to help us. He did and 1 month later my husband, our baby and I were finally being interviewed.
I heard many other “horror” stories about USCIS, so even though technically you can do everything by yourself, it is not always the best choice.
Above said, getting a lawyer is a HUGE waste of money. Even after going through the difficulties that we did, lawyer’s help doesn’t cost $12,000, $6,000 or even $2,000.
So what can you do?
I strongly recommend checking out K1Visa Experts website. The site is operated by a guy named Art Saborio, who has tons of experience and knowledge on K1 visa and green card application processes and who is VERY helpful. I wish I knew about this site when we were going through the hassle of getting a green card.
Keep in mind though that if you or your Russian wife broke the law, getting green card through marriage may be difficult, so if this is the case, unfortunately you do need a lawyer to help you out.
